- 진보성 요건에 대한 법경제학적 접근 -
진보성 판단은 특허법 해석의 중심에 있음에도 불구하고, 오랫동안 애매 하고 예측할 수 없는 법리로 여겨져 왔다. 이론적으로 진보성을 해석하는 방식은 크게 두 가지로 나눌 수 있다. 하나는 인지적(기술적) 접근법 (cognitive approach)으로 통상의 기술자를 기준으로 한 개인의 창작성과 연결 하여 진보성을 해석하는 것이다. 다른 하나는 맥락적 접근법(contextual view) 으로, 기술 수준뿐만 아니라 여러 사회적, 경제적 상황(맥락)을 전반적으로 고려하여 진보성을 판단하는 것이다. 이 논문은 후자의 방법론에 근거하여 경제적 접근법을 통해 진보성 요건 을 해석하고 그 판단방법을 연구하는 것을 목적으로 한다. 미국과 달리 국내 에서 특허제도에 대한 경제적 분석은 주목받지 못해왔다. 이는 한국 사법제 도의 특성 등이 미국과는 다른 현실적인 이유가 가장 크게 작용했을 것이다. 그럼에도 이러한 접근법은 진보성 판단에 있어 사후고찰을 방지하고 특허 의 품질을 제고하는데 유용한 수단이 될 수 있다는 점에서 연구에 의의가 있다. 이를 시작으로 국내에서는 주목받지 못하였던 특허제도의 실용주의 적 접근법이 특허법의 법리해석에 하나의 주요수단으로 자리 잡을 수 있게 되기를 기대한다.
An Economic Approach to the Non-Obviousness Requirement
Although assessing nonobviousness is at the center of patent law system, it has long been considered indeterminate and unpredictable. Theoretically, there are two ways to assess nonobviousness standard. One is the cognitive approach, which determines nonobviousness of inventions by linking it to individual’s creativity from the PHOSITA(Person Having Ordinary Skill in the Art)’s perspective. The other is the contextual approach, which considers not only the technology but also various social and economic situations as a whole. Based on the latter approach, this paper is trying to analyze nonobviousness requirement and suggest a method for assessing nonobviousness through the economics. Unlike the United States, the economics of the patent law has not received much attention in Korea. It is almost because the characteristics of the Korean judicial system are different from those of the United States. Nevertheless, this study is meaningful in that the understanding patent system through economics can be a useful tool for preventing hindsight and improving the quality of patents. Starting with this study, I hope that these approaches to the patent system, which has not received much attention in Korea, will become one of the major means for understanding it.
